Terms of Service

Welcome to Loothero. These Terms of Service govern your use of the online reward platform Loothero at https://loothero.io.

§ 1 Scope

(1) These Terms apply to all users of the Loothero platform, regardless of country of residence, unless mandatory laws of the user's country of residence provide otherwise.

(2) Conflicting terms proposed by the user are not accepted unless we expressly agree to them in writing.

(3) Loothero is intended for adults (at least 18 years of age or the legal minimum age in the respective country).

§ 2 Contract Formation and Registration

(1) By registering, the user submits an offer to enter into a user agreement. The contract is formed when Loothero confirms registration (e.g. by activating the account after email verification).

(2) The user must provide truthful and complete information during registration and keep it up to date.

(3) Each user may maintain only one account. Multiple accounts are prohibited and may result in immediate suspension of all affected accounts.

(4) The user is responsible for keeping login credentials confidential and is liable for all activities conducted through their account.

§ 3 Description of Services

(1) Loothero is an online reward platform where users can earn points by completing offers and tasks.

(2) Point system: Points are credited when an offer or task is demonstrably completed in accordance with the respective requirements. The point balance is displayed in the user account.

(3) Offers and tasks: Available offers and tasks are provided by Loothero or partners. Availability, type and reward amount may change at any time. Loothero does not guarantee continuous availability of individual offers.

(4) Payouts: Users may redeem accumulated points for cryptocurrencies or gift cards, provided payout requirements are met. Available payout methods are displayed on the platform.

(5) Affiliate system: Users may refer others via personal referral links and receive compensation for qualified actions by referred users in accordance with the applicable affiliate terms.

(6) Guide system: Users may create, share and rate guides for offers. Guides are subject to community guidelines and may be moderated or removed by Loothero.

(7) Loothero may expand, restrict or discontinue platform features at any time.

§ 4 User Obligations

The user agrees in particular not to:

• manipulate, defraud or deceive when using the platform or completing offers;
• use fake accounts, multiple accounts or third-party identities;
• use automated tools, bots, scripts or other means to automate offers or the point system;
• provide false information in profile, guides or support requests;
• violate applicable law or publish unlawful, offensive or harmful content;
• infringe third-party rights, especially copyright and trademark rights.

§ 5 Points and Payouts

(1) Points do not constitute a legally binding monetary claim until a payout is approved and have no fixed monetary value outside the platform.

(2) The minimum amount for a payout is 500 points, unless a different amount is displayed on the platform.

(3) Payout requests are processed within up to 7 business days. Loothero reserves the right to suspend payouts for review, especially if fraud or a breach of these Terms is suspected.

(4) Loothero may reject payouts or withhold points if there is suspicion that points were obtained unlawfully.

(5) For cryptocurrency payouts, the user is solely responsible for the accuracy of the wallet address provided. Incorrect entries may result in loss of the payout; Loothero is not liable to the extent permitted by law.

(6) Loothero may adjust payout fees, exchange rates and available payout methods at any time. Changes will be communicated on the platform.

§ 6 Suspension and Termination

(1) Loothero may temporarily or permanently suspend user accounts for breaches of these Terms, fraud, manipulation or abuse.

(2) In cases of proven fraud or serious violations, all unredeemed points in the affected account are forfeited. Payouts already made may be reclaimed where permitted by law.

(3) The user may terminate their account at any time by requesting deletion at support@loothero.io. Pending payout requests will be processed before deletion unless suspension grounds apply.

(4) Loothero may discontinue the platform in whole or in part. In such cases, legitimate verified payout claims will be processed where possible.

§ 7 Limitation of Liability

(1) Loothero is fully liable for intent and gross negligence and for damages resulting from injury to life, body or health.

(2) In cases of slight negligence in breach of essential contractual obligations (cardinal duties), liability is limited to foreseeable, typically occurring damage.

(3) Otherwise, liability is excluded to the extent permitted by law. Loothero is not liable in particular for third-party failures (offer partners, payment providers, networks), technical disruptions or data loss unless based on intent or gross negligence.

(4) The above limitations also apply in favor of Loothero's vicarious agents.

§ 8 Changes to These Terms

(1) Loothero reserves the right to amend these Terms with future effect if objective reasons require it (e.g. legal changes, new features, business model adjustments).

(2) Users will be notified of material changes by email or platform notice. If the user does not object within 14 days of receiving the notice, the amended Terms are deemed accepted. The right to object will be highlighted in the notice.

§ 9 Applicable Law

(1) The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the user is a consumer residing in the EU, mandatory consumer protection provisions of their country of residence remain unaffected.

(3) Place of jurisdiction for merchants and legal entities under public law is — where permitted — Germany.

§ 10 Dispute Resolution

(1) The European Commission provides an Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

(2) Loothero is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
